SMS Terms of Service

Hajoca Corporation (hereinafter, “Hajoca,” “We,” or “Us) is offering a text message-based notification service (the “Service”) subject to the following Terms of Service. These Terms of Service constitute a legal agreement between you (hereinafter “You,” or “User”) and Hajoca, and by opting in to or using the Service, You accept and agree to the following:

1. Users will “opt-in” to the Service by entering their mobile number into the form (Web and/or print?) provided by Hajoca. By providing Us with your mobile phone number when You opt-in, You authorize Hajoca to contact You via text message at your mobile phone number using an automatic telephone dialing system or device, or any other computer assisted technology as applicable.

2. Once opted-in, You will receive text messages (SMS/MMS) to your mobile number. These messages will include information about your deliveries such as “out for delivery”, “next stop”, and “delivery completed”.

3. You can “opt-out” of the Service at any time by just replying “STOP” to message from Us. After You send the message “STOP”, You will receive a reply SMS message to confirm that You have been unsubscribed from the Service. Once You are unsubscribed from the Service, You will no longer receive SMS messages from Us. You may restart the Service at any time by ____________.
4. If you are experiencing any issues, you can reply with the keyword “HELP”, or you can get help directly from Us by reaching out to your Hajoca contact.
5. Message and data rates may apply for any messages sent to You from Us and to Us from You. The number of messages You receive from Us per month will be based on the message type(s) You subscribe to and number of deliveries. Carriers, such as AT&T and Verizon, are not liable for delayed or undelivered messages.

6. If You have any questions about your text plan or data plan, please contact your wireless provider.
7. Hajoca will not rent, sell or share your SMS number with any third-party company for marketing or any other purpose outside of your day-to-day business with Hajoca, unless we have Your consent.
8. Hajoca may use or disclose Your SMS number in any of the following limited circumstances:
a) We have your consent.
b) We need to enforce our Terms of Service.
c) We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims.
d) We believe it is necessary to share Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Hajoca’s Terms of Service, or as otherwise required by law.
e) If the information is shared anonymously as aggregated information with others. For example, the number of people who used the Service in a given month or the total number of texts sent in a given week.
9. You understand that you are not required to consent to the Service to receive any other services from Hajoca.
